Legal Question in Credit and Debt Law in Texas

Unlawful actions by a creditor against a debtor

Would unlawful actions by a creditor be relevant in court?

Actions include:

The creditor has stated to third parties that the debtor had threatened to kill a family member of the creditor.

The creditor has stated to third parties that the debtor is under investigation by the FBI.

The creditor repeated the federal investigation allegation to associates of the debtor. This impacted the debtors participation in a multi-million dollar project.

The creditor and their associates created an online profile with defamatory material about the debtor and messaged the debtors associates with a link to the profile.

The creditor and their associates have sent threatening and harassing messages to the debtor on a social networking site. Messages contained veiled threats of violence if the money was not repaid.

The creditor signed up for an email address under an alias and used it to harass friends of the debtor with messages intended to smear the debtor.

The creditor has hired a Plano, TX. attorney to take legal action against the debtor, who is not represented by counsel. The debtor has repeatedly raised these issues with the creditors attorney. The attorney continues to insist the actions are irrelevant.
