Legal Question in Credit and Debt Law in Texas

Verbal Contract Enforceable?

I recently helped a friend with bad credit obtain a cell phone for their use and signed a two year contract. We are 6months into the contract and the person is now 2 months behind. They agreed to pay the monthly bill (verbally) - I had to turn off the phones and void the contract thus incurring $400 in late charges and cancellation fees. Since this was a verbal agreement between the two of us and there were other people witness to this is there any way I can get the money from the person who is refusing to pay? The final bill is almost $600

Re: Verbal Contract Enforceable?

Verbal contracts are enforceable! The problem usually comes up in proving up the terms of the agreement.

You'll probably want to take the matter up in Small Claims, but collecting on the judgment will be the most difficult part.
