Legal Question in Credit and Debt Law in Texas

Voluntary Reposession

I have not been able to make my car payment for a couple of months now and the car is not running and I can't afford to fix it. I also have lost my job, so I called the finance company and told them to pick it up. They were harassing me about payments and threatening repossesion, but when I called and told them I was jobless and the car wasn't running and asked them to pick it up, they just kept saying that I need to make my payments. What can I do to make them come pick this car up? Do they have a certain amount of time in which they can come pick up the car? They can't just let it sit here, I'm not paying for it...

Re: Voluntary Reposession

They will come and get it when they get around to it. It can sometimes take months. But, remember the can come after you for the balance and and costs or expenses incurred in connection with the repo including the deficiency balance on the loan including all late charges.

They'll get it when they want to. There's nothing that says they have to convenience you by removing it from your property. But when they do, it will be on your nickel.-
