Legal Question in Credit and Debt Law in Texas

Voluntary returned vehicle, where do I stand?

I voluntary called the auto dealer to have them pick-up the vehicle. Now they are tring to sue me for repossession. Where do I stand, if I turned in the vehicle voluntary and it was not repossessed for non-payment or any other reason. If more information is needed, please let me know. I await for your reply.

Thank You

Re: Voluntary returned vehicle, where do I stand?

Surrendering the vehicle to the dealer is not often a good move. The dealership will sell the vehicle, usually at a deeply discounted price [often to themselves or a friendly buyer] and you will be held responsible for the difference between the sales price and the amount of the loan against the vehicle. There may be add-on's for attorney's fees, court costs, continuing interest, etc.

The only remedy left to you at this point is to wait until they send you the bill for the deficiency, and litigate with them if the sale of the vehicle was not for a commercially reasonable amount.
