Legal Question in Credit and Debt Law in Texas

wage garnishing

I was recently sued by my aunt for

monies owed, which was a gift 2

years ago that she now wants back.

I live in the state of washington. My

attorney states that I could get my

wages garnished if she gets a

judgement against me. If I move to

the state of Texas can I avoid this

and what type of action can she

take? I have no real property and

am a single mom. I can't afford to

have my wages garnished.

Re: wage garnishing

In Texas, wages cannot be garnished to satisfy a civil judgment. The judgment can be filed in Texas, and with renewal, valid for at least 20 years. It can be executed only against non-exempt property.
