Legal Question in Credit and Debt Law in Texas

won default judgement and still have lein on home

Got a summons, got a lawyer, won by default, hasseled by debt collectors, got promo's from said company to still buy product and 4 years later have lien agaisnt my homestead home. Know about 10 year limit but, put a ''damper'' on any type of loan on house or refinance. I had AAA credit now this is on my credit report, I don't like... Hate to cause ''waves'' if I really can't get this off my report without more trouble? The bank wants me to summit court papers to credit companies, but I am affraid this promblem will start all over again when they contact the company? should I just wait another 5 years, should I summit default papers, what? Bank has copies but they won't loan money with another lien on my property,as long as that is on my credit.

If I understand correctly that you got the default judgment - I'm not sure how - then you need to intiate legal action against the company for the wrongful lien and defamation of credit. There must be dozens of lawyers in your area who would talk to you about this case.

If you won the lawsuit, what is showing up as a judgment lien on your property? If what you are saying is true, that is fixable. Your bank is correct that you need to dispute this in writing with each of the credit reporting bureaus and include a copy of the default judgment. The ten year limit is for judgments, judgments are good for ten years and may be renewed for another ten years. A debt may be reported on your credit report for seven years from the date of last activity. The statute of limitations for suit on a debt in Texas is 4 years. I'm not sure I fully understand your question. What exactly is showing up on your credit report and/or as a lien on your homestead?
