Legal Question in Credit and Debt Law in Texas
wrongful repossesion
My vehicle was repossed wrongfully. The Finance company did call and apologize and told me I would have my car first thing in the morning - the day after it was repossesed. Am I required to sign a release for the vehicle since it was taken from my home without reason or my permission?

Re: wrongful repossesion
NO, do not sign a release, and you are not required to sign a release to receive your car back. Hire an attorney immediately, and have him send a demand letter to the finance company and to the repossession agent, with copies to the State of Texas agencies who regulate both of them. Then, sue immediately in District Court and ask for immediate turnover of the vehicle, actual and punitive damages.
