Legal Question in Criminal Law in Texas

I had 6 days to go on a weekend jail sentence. I didn't get a chance to finish because of my transportation. If I have a warrant will they let me sit out my 6 days or will they give me more time?

You will definitely sit out the 6 days but you should check with a local bondsman to see if there are any additional charges or warrants out. The failure to turn yourself in could be punished by contempt of court (up to 6 months.) You should not delay in turning yourself in or you may cause the judge to be more angry.

You will serve the 6 days and you will likely receive another charge for unauthorized absence from a correctional facility. However, you should consult with an attorney and a bondsman. An attorney will be able to negotiate for you and a bondsman will be able to assist you with release from jail if the Judge sets a bond for you. I would imagine that if the Judge does set a bond for you it will be high because of your failure to report back to the jail as instructed.

For your convenience I have listed the elements of the offense of unauthorized absence from a correctional facility and the range of punishment:

(a) A person commits an offense if the person:

(1) is sentenced to or is required as a condition of community supervision or correctional programming to submit to a period of detention or treatment in a community corrections facility or county correctional center;

(2) fails to report to or leaves the facility, the center, or a community service assignment site as directed by the court, community supervision and corrections department supervising the person, or director of the facility or center in which the person is detained or treated, as appropriate; and

(3) in failing to report or leaving acts without the approval of the court, the community supervision and corrections department supervising the person, or the director of the facility or center in which the person is detained or treated.

(b) An offense under this section is a state jail felony.

A state jail felony carries a range of punishment of 6 months to 2 years in a state jail. That is day for day time. There is no good time credit.
