Legal Question in Criminal Law in Texas
There was three (3) house guest at a residence that was served a no knock warrant. Neither of the occupants (guest) had any official connection to the house such as mail clothes or bills. The warrant was for a narcotic with two (2) names and two (2) addresses in which included the adjacent house that neither occupant had any official connection to. One of the persons saught on the warrant was amongst the three (3) occupants in the house. The other person named on the warrant was not at either house stated on the warrant. The police found handguns in the house that was occupied by the three (3) detained occupants. Of the three (3) detained occupants neither had any prioir felonies. The search did not procur any other illegal evidence. The police also took into evidence a ring of keys in which was in the inside lock of the backdoor of the first house searched. On the keys on the ring fit an obsolete lock that opened a doorknob to the house next door that was included on the warrant. That particlar doorknob didn' actually lock because of all the break-ins at that residence. There was a master-lock set added on the outside of the door to secure the house. The master-lock was locked at the time of both searches. From the second (2nd) house on the warrant the police officers obtained a undisclosed amount of narcotics. As I stated prior that house in which the narcotics was found was unoccupied. All three (3) occupants was arrested and held on a forty-eight (48) hour hold.
