Legal Question in Criminal Law in Texas
3 months ago Quest Apartments took over $1000 from my bank account while I was in Australia trying to make a living, but before then I was in New Zealand and stayed at there place this happen a little after I left that I didn't notice and then months later again that drained my bank account while I was in Australia that caused a lot of problems for me.
They said it was a computer error and that the money will be refunded. After many calles and constantly being told that the money will be refunded in 2 weeks. Its been 3+ months and never getting my money back.
I was wondering if I could sue or do anything about it? I don't even know what I'd be sueing under. I can't find any legal advice or people or attorneys that will give me advice. I don't even know what to put this under.

It is probably not a criminal question. I am not a civil lawyer but what I would personally do is put a demand in writing for an immediate return of your money (within 24 hours of receipt of the letter) and in addition any charges that you suffered as a result (bounced check charges, etc.) You should detail the charges. I would then hand deliver the letter to the office of the apartments and have someone sign a receipt saying that they received it. Then, I would file a claim in small claims court. You might talk to local lawyers who handle small claims suits about handling the case so that it is handled properly. If you do not hire a lawyer, you should be able to handle it yourself. The court may have forms that you can use. Good luck.
