3rd DWI - Can we get a 1244A if the 1st DWI is 20yrs old ?

DWI is a 3rd degree felony - not a state jail felony. So, 12.44 does not apply.
Some times prosecutors will reduce the charge to a misdemeanor.
You definitely need a good lawyer.
