1st degree felony
if items were found in a vehicle w/ the owner driving, why would both driver & psgr not face the same charges?How does who gets what charges determined??

If you are talking about possession charges, then they charge whoever knowingly had car, custody, control, or management of the contraband. Driver and passenger are often charged with the same thing. If cops felt that items belonged to one and not the other, then only one will get charged.
