What do you mean by a 5th degree felony? Texas has a capital charge, 1st, 2nd, 3rd and state jail felonies.
If you have a felony conviction, it will not come off of your record (expunged) without a governor's pardon. Depending upon the age, consequences and circumstances of the conviction, it might be possible to get the conviction set aside, and then apply for a nondisclosure.
