Legal Question in Criminal Law in Texas
my 19 year old son was charged with a misdemeanor of controlled substance offence (marijana) under 2 oz. and possession or delivery of drug paraphenalia. He has never been in trouble with the law before. It occurred in Brenham, TX 77833 . What are our options and what shoudl we do? Is there anyway to avoid this going on his record?

This is a Class B misdemeanor, carrying up to 6 months in jail or up to 2 years of probation. I would recommend that you hire a local criminal defense attorney to represent your son. There are ways to avoid a conviction on this case. In order to later qualify for an expunction (where the State erases all records of his arrest), his case would either have to be dismissed or he would have to be found not guilty.
