Legal Question in Criminal Law in Texas
My 18 year old step son was arrested again on possession of marijuana while on probation for the same offense 6 months ago. He was in a car with 3 other people and not driving but was the only one arrested. His friend is going to tell the DA it was his pot however my son has refused counsel and will represent himself. What are his chances of getting off this charge? I don't like his chances and have begged him to let us hire an attorney!

First of all, get him a lawyer and don't let him talk to the DA. Anything he states to the DA can and will be used against him and he could be admitting to a violation of his probationary terms which will be used against him in a Motion to Revoke his Probation which more than likely will occur. A should lawyer can do a better job.
