Legal Question in Criminal Law in Texas

I have a 50 year old tenant (male) who has only lived here 6 weks. I just found out he is having a sexual relationship with a 17 year old boy and has had for over 3 yrs!! The boy is homeless, refuses to go to school, has no I.D., no driver's license, so he may be 14 for all I know. The tenant says I have to refund his Sept rent even if I do evict him, is this right? S.A.P.D. says the boy is of legal age for this relationship! How can this be? Thank you so much

I don't deal with landlord/tenant issues, so I won't comment on that. As for the rest of it, the age of consent in Texas is 17, so there is nothing wrong with a 17 year old and a 50 year old being together. If there is some proof that something was going on before the young man turned 17, then the 50 year old will likely have a problem and a possible criminal charge.
