Legal Question in Criminal Law in Texas
When I was 19 (about 12 years ago), I was arrested for a class B misdemeanor theft ($50-$500). I actually shoplifted from Wal-Mart...I opened two boxes of football cards and took cards from each box. The thing is, each box was only valued at $24.95 bringing the total to $49.90...not $50-$500. The sales tax is what pushed the fine into the class b range of $50-$500. This sounds ludicrous to me now that I've thought on it for many years. Shouldn't this offense be a class C misdemeanor? I'm hoping that I can get this offense expunged from my record but I don't think I can have a class B misdemenor expunged. Any help?

It doesn't matter what it should have been, it is a dead issue now. It's too late to reopen it. If you got deferred, you can get this an Order of Nondisclosure, but not an expunction.
