Legal Question in Criminal Law in Texas

I have an 18yr old niece who was arrested for shoplifting. She did not have the item on her possession, her 14 yr old bro. did. She was arrested, spent the night in jail and now has to go to court. Should she havve been arrested sisnce she did not steal the item?

Maybe she shouldn't have been arrested, but the fact is that she was. Now she needs to retain an attorney to advise her on how to go forward. The attorney is able to view the evidence of the prosecutor, and can help her make an informed decision as to her options.

Based on what you have written, your niece possibly should not have been arrested at the point in time. Unfortunately, she was and your niece will need an attorney to assist with the case. The attorney, after viewing the states evidence, will provide her with options. A theft conviction can be extremely detrimental to your niece's future - as theft is a crime of moral turpitude.
