Legal Question in Criminal Law in Texas

My 17yr old son is being blamed for backing into a peterbuilt semi truck and doing over 3,000 in damages to it , my son drives a chevy truck which has no damages not even a scratch, my insurance investegated both vehicles a denied to fix the semi truck because there were no damages to my son truck and because my son did not back Into that semi, now the owner said he was going to the sheriffs office to fill charges on my 17yr old son , can he do that . What do I do.

He can try to press charges, but that does not mean the police will try to charge your son or whether a prosecutor will want to charge your son. There really isn't much you can do. If there is no damage and there is no proof that your son did anything, the odds of him getting charged sounds low to me.

It couldn't hurt to hire a lawyer the second the cops decide they want to talk to your son, if it even gets that far. The lawyer could then assist with any police questioning. Your son has the right to remain silent and it is usually a good idea to exercise that right. Let the lawyer do the talking.
