Legal Question in Criminal Law in Texas
My 13yr old son (along w/a few others) was charged w/engaging in organized crime today. This all took place at school, i was not present when they questioned him or arrested him which is my 1st question, is that legal? they are saying that my son & these boys are a gang because they named themselves. they said that my son was involved in one assault & witnessed others. These so called assaults are from what they are sayin were initiations into the gang. which leads me to believe that they can not be assaults. they seem to be jumping from one side to the other. they shouldnt be able to have it both ways. its either gang activity on both sides or an assault. we are suppose to appear before juvenile probation on 10/19. should i get a court appointed lawyer? i would also like to know the legal definition of assault & oraganized crime. can you please help me w/this, thank you.

Your son needs an attorney experienced in juvenile and criminal law. Be sure and tell the attorney that you were not present when your son was questioned.
