Legal Question in Criminal Law in Texas

In 1983 when i was 18 yrs old i was charged with theft and forgery. There was no trial,we met in the judges chambers.

For my participation the theft charges were dropped. Forgery was deferred with 2yr unadjudicated probation and restitution.

30yrs later this charge has presented itself on a job application. I have never had this problem before. I am a registered nurse and would like to apply for an out of state license. Can this be removed from my record?

Somewhat. It cannot be expunged if you had a deferred adjudication. That would have removed it from the record.

It should be able to be non-disclosed, depending on the circumstance. That does not remove the record, but prevents most agencies from disclosing it. Certain people/agencies will still be able to see it, including Texas licensing agencies, law enforcement, and certain regulated firms such as banks. I don't know about out-of-state agencies, though. Most employers, apartments, etc. can't get the information.
