Legal Question in Criminal Law in Texas

abuse

i was beaten and thrown from my own moving car by my boyfriend... i was taken by ambulance to the er. he had been drinking and was intoxicated... two days pass now and i find out he was never even arrested, i cant press any charges until the first of january 2008 ... what legal action can i take

WHAT?

You can't press charges until tomorrow? I have NEVER heard anything so odd. Call more cops, complain louder, call the District Attorney's Office.

Make sure there are pictures of your injuries. Did the hospital take pictures. Get a copy of your medical records.

From what you have written, you have a civil cause of action for assault. An important issue with any civil lawsuit is whether there are resources to pay the judgment. What sort of insurance did he have?
