while on active duty
Can a Soldier serving on active duty be charged with a criminal or civil case, are could it be held until the Soldier is discharged from the army?

Anyone can be charged with a criminal or civil allegation. Depending upon whether the case is civil or criminal, will determine if the military service member's case will be finalized. Under the Servicemembers Civil Relief Act (formerly Solider and Sailors Civil Relief Act), generally an active duty service member might be eligible for a stay of the court proceedings until the active duty service member returns state-side.
