Legal Question in Criminal Law in Texas
after admission of guilt
A woman in our company stole over $40,000 that could be proved with no doubt. She finally pleaded guilty, got probation and had to pay back the company on a monthly basis. Years later she goes to the DA with a lawyer and says she did not take all that. The DA goes to the judge and the judge lowers by $10,000 what she has to pay back. The company she stole from was never informed of this action; had on input. The monthly check amount was lowered. Can this be reversed? If so, how.

The company could file a civil suit to recover the balance owed; IF the statute of limitations has not passed. The restitution is a condition of probation, and the judge has the right to alter the conditions of probation. The DA is not obligated to be a collection agency.
