Legal Question in Criminal Law in Texas
Under the advice of my sons attorney he took a guilty plea and now finds out he should not have. Are their lawyers that specialize in overturning plea deals in Texas.
1 Answer from Attorneys
There are many lawyers in Texas who handle post conviction matters including motions for new trial and appeals, and post conviction habeas corpus. If it is within 30 days, then you may be able to find a lawyer who can file a motion for new trial. If it has been more than 30 days, then you need to find a lawyer who handles habeas corpus matters. In order to bring the case back to court on habeas corpus, there must be some kind of constitutional violation (such as ineffective assistance of counsel) or actual innocence. It is a difficult burden to overturn a case but it is not impossible.
