That depends on his history, the facts of the case and his lawyer. Probation is a possible option.

Aggravated assault with a deadly weapon is defined in the Penal Code ch. 22.02.

The range of punishment is listed below.

� 12.32. FIRST DEGREE FELONY PUNISHMENT.

SUBCHAPTER C. ORDINARY FELONY PUNISHMENTS

(a) An individual adjudged guilty of a felony of the first degree shall be punished by imprisonment in the institutional division for life or for any term of not more than 99 years or less than 5 years.

(b) In addition to imprisonment, an individual adjudged guilty of a felony of the first degree may be punished by a fine not to exceed $10,000.

� 12.33. SECOND DEGREE FELONY PUNISHMENT.

SUBCHAPTER C. ORDINARY FELONY PUNISHMENTS

(a) An individual adjudged guilty of a felony of the second degree shall be punished by imprisonment in the institutional division for any term of not more than 20 years or less than 2 years.

(b) In addition to imprisonment, an individual adjudged guilty of a felony of the second degree may be punished by a fine not to exceed $10,000.

A jury or judge can assess from 2 to 20 years in prison and a fine not to exceed $10,000.00. However, if he has no previous felony convictions, he is eligible for probation and may be released.
