Legal Question in Criminal Law in Texas

Last answer didn't help.

Here's a little more detail. My boyfriend is in Montgomery county jail because his parents said he stole some movies and video games and pawned them. This is his second offense of theft, therefore he has a class b misdemeanor ($50$500) because his parents pressed charges on him for taking some of his sisters pills.. What are the chances of him not getting any jail time!?

Re: Last answer didn't help.

What other criminal history does he have besides the prior theft?

If there is no other criminal history, he would probably avoid jail easily with a probation plea. On the other hand, that may not be in his best interest if he would have a problem surviving probation. Might be best for him to take a jail sentence and just get it over with. He would also have credit towards any jail sentence of however many days he has been sitting in jail.

This presumes, of course, that he is planning on pleading guilty.
