Legal Question in Criminal Law in Texas
I was arrested in Brenham, TX (Washington County) for possession of Marijuana under 2 ounces. I am a resident of Austin, TX. I was driving to Houston when an officer pulled me over for a dim headlight. The light actually passed inspection but the officer said it looked too dim and wrote me a warning for it. He said he smelled marijuana and asked if there was any in the car. My passenger and I said no. He told us he was going to search anyway so we told him there was one gram and gave it to him. He arrested me and I went to jail for one night. My court date is February 24th and I have no prior offenses. Should I get a lawyer or is it pointless since I already admitted that it was mine?

Get a lawyer in Washington County as they will be familiar with the Judges and prosecutors. If you can get deferred adjudication, at least you could petition for non-disclosure in the future. Your attorney should be able to negotiate on your behalf for the best outcome possible, based on the facts in your case.
Based on what you have written, you should have a law firm represent you. There are many options potentially available to you. Some options may result in a complete and true dismissal and your eligibility for expunction whereas other options would result with you being able to file a non-disclosure after a time period. If my law firm can assist you with this legal issue or any other legal matter, please contact my law firm at [email protected] for an initial consultation.
