Legal Question in Criminal Law in Texas
IF I had been arrested due to Family violence which my daughter said I hit her which I did not A person in my home was fighting me and my daughter tried to break it up and got hit and police arrested me I was intoxited and put in police car and ask who call the police and the police said your daughter did, I said I ought to kill the bitch, can they legally file felony charges on me for that statement. I am on bond now for that charge and misdeamenor for family violence, The police did not file A restraining order on me either. If they thought I was that dangerous to make A statement why did they not file papers. I would not kill anyone I was just DRUNK. My daughter still lives in my home. She is 42 yrs old. I am 62 yrs of age and me and my wife who is 71 yrs of age and have raised 3 of her children and they have all graduated and these children have got learning disabilities. My wife has had cancer, had her spleen removed due to her platelets being low. I have liver disease hib b/and found out last week that I have to have surgery. So I can say I need HELP. Can felony case be filed on me legally. PLEASE HELP ME . Also my daughter has A learning disability also. 469-200-5236

You need to hire a lawyer to handle your complicated situation. They only file protective orders if requested by the complainant. Hitting your daughter, even if by accident while trying to hit someone else, is a crime. As far as the felony charge, that is a stretch and your lawyer may be able to get the offense dismissed.
