I was assaulted at a neighbor's birthday party by another guest. That guest now has an assault charge pending. Can I also file a civil suit for pain and suffering?

Based on what you have written, it appears that you might be able to file a civil law suit against the alleged guilty party. Generally, the main item in cases, such as your's, will be your physical injuries and the costs associated with those physical injuries.
