Legal Question in Criminal Law in Texas
Assault charges
I was recently arrested for a warrant on assault charges, but i was never notified that i had these charges pending. I later found out that the charges filed were due to an argument I had with my spouse. Apparently even though my wife didnt file charges against me, the state went ahead and filed them. For months I was not aware they had done this until I was pulled over by a Trooper and arrested. Is there anyway I can have these charges dropped or removed from my record? Is there anything my spouse could do to rectify this?

Hire a lawyer. Your wife can sign a non-prosecution affidavit. The ADA will sometimes drop the charge -- depends upon the circumstances of your case.
