Assault charges on 14 yr old

My nephew was being bullied at school, and then thrown against a wall in the hallway ... being choked and punched. He got lose from the guy and told him to take it outside. Once outside, the kid continued taunting him until a friend stepped in. The kid then punched the friend, causing my nephew to react. A fight incurred and the boy ended up with a broken eye socket. Now, of course, the parents are pressing charges because their son lost the fight! Can't my nephew counter sue (even though the officer told my brother it was ''2 separate fights'')? Can't the friend press his own charges since he was hit for no reason and never threw any punches? My nephew had walked away from this guy all week ... and has not been in trouble before!

Your nephew needs a lawyer. The friend should certainly file charges, and he is a witness, who can substantiate the chain of events.
