Assault

What are the conviction chances of the following: I have been charged with assault because my ex boyfriend and I were having an argument, I was walking away, he said something ugly to me, I turned to answer him, about 10 feet away, was finished with my cigarette and tossed it to the ground, and as I turned he had turned and was walking to the left in the general direction I threw my cigarette, he said I have you now bitch I will have you charged with assault. I continued to leave, was about a block or so away, he was still following me, cussing, saying he was going to call someone to say they witnessed the whole thing, and maybe 15 minutes later finally called the police to report he had been assaulted by a cigarette butt. I was not arrested but was issued a citation for assault by contact.

If you have never been in trouble before, you may be able to get deferred for this scenario -- but an attorney can probably get you a better deal, possibly a dismissal.

Hello there,

Assault by contact for a cigarette but that didn't even hit him. This is crazy. Hire an attorney to either get this dismissed or go to court and have a trial so you can hear a two word verdict of NOT GUILTY.

If you were in Tyler I would do the case for free.

Talk to some lawyers in your area to see if anyone will represent you pro bono.

You could even try this case yourself by simply testifying from the narrative to a JURY.

DO NOT REQUEST A BENCH TRIAL IF IT COMES TO A TRIAL REQUEST A JURY TRIAL.
