Texas Penal Code Section 22.02 states that it is an aggravated assault if the defendant uses or exhibits a deadly weapon, and it is second degree felony. It rises to a first degree felony under certain conditions.
A second degree felony is punishable by 2-20 years in prison and a fine not to exceed $10,000. A first degree felony is punishable by 5-99 years in prison and a fine not to exceed $10,000.
