Re: Assuault Family Violence
Hello there,
The state will pick up the case and some counties will subpoena you and force you to testify against your husband. If however, there you are concerned about your testimony i.e. a false statement to police officers, etc., you could assert your 5th amendment rights under the United States Constitution against self incrimination.
Speak with a criminal attorney in your area that will stand up to the District Attorneys and ask for legal advice. If you cannot afford an attorney the court will provide one for you if you ask for one.
I have not provided you with any legal advice in this answer, I have only provided you with a hypothetical answer as to how one could possibly keep from not having to testify.
Sincerely,
Erick Platten
