Legal Question in Criminal Law in Texas

Attempted Murder

A man my sister hardly knew broke into her home one night while she was asleep, and tried to rape her. Her son came home, caught the man drug him outside and was whipping his butt when he got away, got into his truck and tried to run over my nephew! My sister had just came outside and when the guy hit my nephew, my nephew flew back into my sister and her head hit the concrete. The police were called. The man had 3 warrants out on him and didn't even get arrested, they wanted to take my nephew to jail for breaking his windshield while hitting it with his body in the run-down. What charges should she file on him? She now has a permanent brain injury and the hospital has put her on permanant disability. How can we get the police to do something about this man he is still around and laughs about the whole thing!
