Legal Question in Criminal Law in Texas

Background Check

I am seeking a new job of which they ran a background check. Something came back. It was from 1995 - theft ($20 - $500). I do not know what this is other than I had a box of checks stolen in 1995. I placed calls to the City of Austin and Treavis County and have no warrant (background check said I had a warrant issued). The County Clerk's Office is investigating the case for they have no information. My question is is how do I get this taken off of my record so as I can move forward with possible new employment?

Re: Background Check

There is no way for me to know which checking service they used. Since you have verified that you have no criminal history, ask both police departments to issue to you what is called a police clearance letter. It usually costs around $10.00. When you make a new job application, advise them of the stolen checks and the false information being reported. Attach copies of the police clearance letter. I would also ask the other employer who they used as a background checker, and submit your proof to them that their information was false. If they refuse to correct their records, you may well have a lawsuit against them. TCL
