background disclosure

when applying for licensing through state insurance depts. background questions are asked regarding criminal history. Having a felony charge, but, no conviction. Is there a time frame for disclosing info? or are you forever, legally obligated to disclose all background information?

You are obligated to disclose the information because most applications require truthfulness or your application may be rejected. Since this a licensing application you are required to be honest or it will be rejected. However, since you were not convicted in this case, it will behoove you to get in touch with a criminal attorney and discuss the possibility of expunging your record or filing a Petition for Non-Disclosure.

Legally, there is no set time limit for disclosing. Whether disclosure is required depends on the question. An example " Have you EVER been arrested or convicted of a felony?. Another example, WITHIN the past 5 years have you been arrested or convicted of a felony? I would be able to give you a better answer if I knew the specific question on the form. Also remember that a deferred is not a conviction.
