Legal Question in Criminal Law in Texas

i have bein charged with possesion of marajuana.Me and a freind were on the staduim at lunch and when we saw the princeable he ditched a joint and he told them were it was but i nvr had it or smoked any. the only thing they have on me is on the camera. it shows earlyer that morning my freind putting the weed on the table i held it n looked at it for a sec then gave it back it was clear it wasnt my weed, and when they searched me afterwords i didnt have anything on me or wasnt under the influence. should i fight the case or let it be?

When you picked up the marijuana, you possessed it. Now, many prosecutors would not push that case forward if the video shows that you did only that and did not smoke any of it.

You should definitely hire a lawyer. The lawyer may be able to talk the prosecutor into dismissing the case against you and your curiosity. If not, then perhaps the lawyer can work a pre-trial diversion for you - to save your record for the future. (It is like being on probation but it is a contract. Once you fulfill the obligations and wait the proper time period, then you can file to expunge the case completely off your record.)

It is definitely worth investigating in a GOOD lawyer.
