Bond Forfiture; Surrender of Principal; Poss over a grm; Poss marjuana

My son was arrested last year in Plano having mushrooms in his pocket. When he asked for a attorney they told him no, that he could afford one (he was moving out of the house he had rented because they could not afford it and were moving in with us). He decided if he couldn't get an attorney he would just ignore everything. He was arrested 02/04/09. He has asked for a lawyer again, but doesn't know if he will recieve one. What do the charges involve and will they deny him an attorney again because with his tax refund he rented an apartment?

If the court determines that he has the resources to retain an attorney, then an attorney will not be appointed. Because of the bond forfeiture, he is in jail and he is more likely to get an appointed lawyer. Court-appointed lawyers are often overworked and underpaid, and you may decide to retain an attorney to represent him.

The court should not deny him of his constitutional right to have counsel' whether he can afford one, that is a separate issue.
