Legal Question in Criminal Law in Texas

bought vehicle; owner refuses to release title

I purchased a vehicle for $15,000. I used a personal check from my bank account. The owners used the money to pay off the note on the truck, but put their name on the title. I have had complete insurance on the vehicle in my name for over a year. They are still refusing to give me the clear title. In the interum, the vehicle was towed from private property. The tow company refused to release the truck to me because the title was not in my name. They did relaese the vehicle to the title holders. I do not know where they have hidden the truck. I believe that they have sold the truck to another person! Is this theft? What are my options?

Re: bought vehicle; owner refuses to release title

The first problem you have is that you did't have a contract to purchase the vehicle.

However, you did write a check for $15,000 and that check can be used against the other people to sue them in civil court for them either to return the truck or your money. The legal theory they would be sued under is called Quasi Contract or Quantum Meriut.

But, I wold also try contacting the police to see if they would investigate the case.
