Legal Question in Criminal Law in Texas

My boyfriend was the victim of an assault. The perpetrator, Adam, followed us in his vehicle frm a store and attempted to hit our vehicle with his. I had 3 small children in the vehicle so we pulled over to allow him to pass. He stopped behind us getting out of his vehicle cursing and yelling. He punched my boyfriend in the nose resulting in a broken nose. My children,who witnessed the entire thing, were screaming and crying. My boyfriend and I left and went to my house which was right down the street,he followed us-tailgating our vehicle all the way there. We called the police to file a report. The county attorney did not press charges due to he believed it was mutual combat even though Adam admitted he threw the only punch. Can I sue him for medical and pain and suffering? And can I sue him for endangering and traumatizing my 3 children?

If you have the name and address of the person who did this, by all means sue him. A jury should give you about $125,000.00. However, you may never collect it.
