Legal Question in Criminal Law in Texas

Breaking the law

If you break the law, are you obligated to turn yourself in? Suppose you broke the law. The law says that if you break this law you have to pay a fine of $500. Are you obligated by the law to pay that fine even though no one knows that you broke the law?

Re: Breaking the law

Hello there,

Theoretically, if you break the law there are consequences for your actions. The range of punishment would vary depending on the law you broke.

However, law enforcement 99.9% of the time arrest offenders by catching them either in the act or by conducting long investigations and building a case against someone.

Now say you smoke some pot and feel you should turn yourself in due to moral responsibility to abide by the laws of the state. You can turn yourself in pot in hand but you may get yourself published or talked about on Jay Leno's Tonight's Shows Dumbest Criminals.

Simply put law enforcement should be the one catching you. You do not have a duty to turn yourself in and you even have a constitutional fifth amendment right not to answer questions where you would be incriminating yourself.

Put down the pot and read the constitution. Its a good read and will help you understand your rights.

Sincerely,
