Legal Question in Criminal Law in Texas
My brother was arrested for Theft 50/500 and has a record. He cannot affort legal counsel. Could he be looking at the maximum jail time?

Assuming you are negotiating a plea bargain, this depends on his record, and the prosecutor and the county.Some counties and prosecutors are simply tougher than others, especially when the defendant has committed lots of other offenses.
Because this is a class B misdemeanor, your brother is entitled to court appointed counsel.
