If it is a Class A misdemeanor, then he could get up to 1 year in jail and up to a $4,000 fine. If they proceed with a felony enhancement paragraph, the minimum jail time is 90 days. If it is a Class B misdemeanor, then he could get up to 6 months in jail and up to a $2,000 fine. If they proceed with a felony enhancement paragraph, the minimum jail time is 30 days. (He could also possibly get deferred adjudication probation for the offense.)
