Legal Question in Criminal Law in Texas
My brother has two prior convictions for burglary of a habitation and is locked up now for another the court has offered 9 years. Is it worth it to bail him out and fight it with attorneys and trial and all that goes with that or let him fight it with a public deffender.

If your brother remains in jail, he will receive credit for the time he serves there on any prison sentence
That is the only advantage of remaining in jail other than saving the cost of bail.
Only an attorney who has reviewed the facts can provide advise on the options of trying the case versus a plea bargain.
Public defenders/court appointed attorneys must meet minimum standers, especially for felony cases. However, a hired attorney does not have to meet those same minimum standards. You can hire an attorney with more experience or less experience. It is up to you to make sure that you have an attorney with the level of experience you need.
The advantage of a plea bargain is that you control the outcome. The advantage of a trial is that it is the only option that offers the possibility of acquittal.
