my brothers case
If some one is already in hand cuffs and the defendant spits at officer is the officer and partner allowed to use self defence for hitting him back.

Hello there,
If the officers hit him while he was wearing handcuffs a civil rights violation can be brought against the officers and the department for excessive use of force.
