Burglary of a habitat
Can one be charged with burglary of a habitat if that person was not found in the home and there is no evidence the person was in the home they were just in possesion of the stolen property

Yes, you can be charged. The real question is can the State prove its case beyond a reasonable doubt based on possession of stolen property. I say no unless they have more evidence.
