Legal Question in Criminal Law in Texas
burglary of habitation
My brother was arrested for above crime and plead guilty. He signed some paperwork during PSI? and he is not sure if he signed away his rights to be able to say no to the sentancing and continue reseting court dates. They have offered him time plus 5 years probation. He is not wanting to take probation, as we is concerned he will not finish. He would not sign and now wants to know if he can continue to reset court dates, or if and when he must take what the judge gives him since he already pled guilty.

Surely he did not plead to a felony without counsel. He needs to discuss this matter with his attorney, to see if the plea can be stricken. It is not likely. What is gained by resetting court dates, and avoiding probation?
