Legal Question in Criminal Law in Texas
Burglary of a Habitation
My fiancee and two of his friends got in trouble and come to find out got charged with burglary of a habitation for the denton county sheriffs house. So far they have offered us 10 years TDC... But my attorney says he will get no prison just probation is that true.

Re: Burglary of a Habitation
First -- trust your lawyer, or get a new lawyer.
Second -- When you go to sign the plea papers, the probation will be set out in the paperwork. If the judge does not follow the plea, then he has to warn you that he will not follow the plea, and you can change your plea to not guilty, and go to trial.
